Reservations

A non-refundable deposit of US$200 per person is required at the time of booking, and the balance of the tour cost is payable not later than 45days prior to departure. Notwithstanding any prior confirmation of arrangements the right is reserved not to execute tours if payment has not been received in accordance with the foregoing. Cancellation In the event of cancellation, notice of which must be given in writing, the following cancellation fees will apply: If 45 days and over forfeit of deposit. If cancelled within 45 days and 25 days of departure date 20% of the tour cost will be charged. If cancelled within 25days and 5 days 40% of the tour cost will be charged. If cancelled within 4 days the cancellation fee will be 100% of the total tour cost

Rates

Rates include all expenses in connection with vehicle and for the itinerary as set out; hotel accommodation with full-board table d'hote meals whilst on safari. In Nairobi arrangements are on a bed and breakfast basis unless otherwise stated. Air costs for scheduled flights indicated in the itinerary are included. We include Government hotel taxes, hotel service charges, and as applicable to the itinerary; all entry fees except where these are specifically quoted separately in the Price List. Not included are any departure taxes, visas, gratuities (other than service charges), beverages, laundry and other such personal expenses.

Accommodation

Where possible we book rooms with private baths throughout on the basis of two persons sharing a double room. Single rooms are available at supplementary costs but neither single rooms nor rooms with private bath can be guaranteed. Single rooms are scarce and cannot be guaranteed even if paid for. Where this occurs an appropriate refund will be made direct to the client. Hotels/lodges/camps, where mentioned, are named as an indication of category and rooms may be reserved at similar hotels/lodges/camps. Transportation Safari minibuses, safari cruisers, cars, four-wheel drive vehicles or coaches will be provided according to the route and the number of participants. The right is reserved to employ the services of sub-contractors. English speaking guides are provided.

Alterations to Tours

The right is reserved to change any route or arrangements should conditions necessitate, to offer substitutes of equal value, or to cancel the operation of any scheduled tour. The right is also reserved to decline to accept or retain any person as a member of any tour at any time, in which event an equitable amount will be refunded.

Liability

(a) The Company is insured against legal liabilities arising from any injuries which might be received by passengers whilst in its vehicle.

(b) The Company and its agents act only as agents of the passenger in all matters relating to hotel accommodation, sightseeing, tour and transport, whether by aircraft, rail, road, motor coach, ship boat, or any other means, and shall not be liable for injury, delay loss or damage arising from any cause and in any manner howsoever except when the passenger is being carried in transport owned by the Company.

(c) The Company's liability to passengers carried in its own vehicles is governed by the respective laws of the country in which the tour takes place and no other country and all claims are subject to the jurisdiction of the courts of the country in which the cause of action arises.

(d) The Company reserves the right to employ sub-contractors to carry out all or any part of the services agreed to be supplied and in the event of the exercise of such right the terms of clause (c) relating to the Company's liability shall apply.

(e) Whilst every care is taken, the Company cannot be held responsible for loss of damage to baggage. It is therefore advisable to effect a separate baggage insurance.

(f)

(i) In the event that a claim is made against the Travel Agent or Tour Operator in respect of any loss or damage occasioned by the breach of contract, negligence or other fault of the Company, the Company shall be liable to indemnify the Travel Agent of the Tour Operator (as the case may be) only of such claim would have succeeded and only to the extent that damages would have been awarded against the Travel Agent or the Tour Operator (as the case may be) had submitted to the jurisdiction of the said courts.

(ii) In respect of any such claim as is mentioned in sub clause (I) of this clause the Company shall be under no liability whatsoever or howsoever arising other that the liability expressly assumed in this clause.

(iii) For the purpose of this clause the Company shall be deemed to include its servants and agents and shall be deemed to contract on its own behalf and on behalf of each servant and agent.

Children

(a) Under the age of 12 sharing a room with two adults generally pays 50 per cent of the rate quoted, except on air safaris and balloon safaris.

(b) Are not permitted in: Treetops, Shimba, Salt Lick, The Ark, Mountain Lodge and Larsens under the age of eight. Other restrictions may be imposed from time to time.

(c) Window seats are not guaranteed for children.

(d) Often rooms in wildlife lodges and tented camps accommodate a maximum of three persons.
